Measures concerning certain products originating in the United States of America
On 16th of May, the Commission published the regulation (EU) 2018/724 on certain commercial policy measures concerning products originating in the United States of America, in response to the safeguard measures adopted by the United States, in the form of a tariff increase on imports of certain steel and aluminium products.
Since, consultations between the United States and the Union did not reach any satisfactory solution after the expiration of 30 days period referred to by the WTO Safeguards Agreement, the Commission is exercising the right to suspend the application of substantially equivalent concessions or other obligations with the intention of rebalancing concessions in the trade relations with third countries.
There are two lists of products impacted by these measures. The first one concerns 182 products that may be subject to additional duties from 20th June 2018 and, the second one concerns 158 products that may be subject to further additional duties from 23rd March 2021 or upon determination of WTO inconsistency of the US safeguard measures.
The two situations where products listed in the Annexes are not subject to additional duties are:
- Products for which an import licence with an exemption from or a reduction of duty has been issued prior to the date of entry into force of this regulation; and
- Products for which the importers can prove that they have been exported from the United States to the Union prior to the date on which an additional duty is applied with respect to that product.
